Indemnity Agreement
Medical QR Bracelet / Jewellery Disclaimer and Indemnity
By purchasing and/or using any medical QR bracelet, pendant, tag, or related product supplied by Charmed Jewellery (Pty) Ltd (“the Product”), the purchaser and wearer acknowledge and agree to the following:
- The Product is intended solely as an additional aid to provide medical information and does not replace professional medical identification systems, emergency services, or medical care.
- While every reasonable effort is made to ensure that the QR code and linked information function correctly at the time of production, Charmed Jewellery (Pty) Ltd makes no guarantee that the QR code will always be scannable, accessible, readable, or functional under all circumstances.

The wearer acknowledges that various factors beyond the control of Charmed Jewellery (Pty) Ltd may prevent the QR code from being successfully scanned or accessed, including but not limited to:
- Damage, scratches, fading, or wear and tear to the Product;
- Poor lighting or environmental conditions;
- Internet, mobile network, or device limitations;
- Software, browser, or compatibility issues;
- Emergency responder procedures or equipment limitations;
- Human error or failure by any person to attempt to scan the QR code.

Charmed Jewellery (Pty) Ltd shall not be held liable or responsible for any injury, illness, medical complication, loss, damage, or death arising from:
- The inability of first responders, medical personnel, or any third party to scan or access the QR code;
- Delayed access to medical information;
- Incorrect, incomplete, outdated, or missing information supplied by the customer;
- Technical failures, server downtime, or interruptions beyond the company’s reasonable control.

It is the responsibility of the purchaser and wearer to:
- Ensure that all medical information provided is accurate and kept up to date;
- Regularly check that the QR code remains functional and undamaged;
- Seek immediate medical assistance in emergencies and not rely solely on the Product.
- By purchasing and/or using the Product, the purchaser and wearer fully indemnify and hold harmless Charmed Jewellery (Pty) Ltd, its owners, employees, affiliates, and representatives from any and all claims, liabilities, damages, costs, or expenses arising from the use of the Product or any failure of the QR code system.
- This indemnity shall be governed in accordance with the laws of the Republic of South Africa.
By completing this form, you confirm that you have read, understood, and accepted the terms of this indemnity agreement.
